Justice Department Settles Housing Discrimination Lawsuit Related to Senior Housing in Santa Rosa, California

WASHINGTON, D.C. ? July 30, 2012 ? (RealEstateRama) ? The Justice Department today announced an agreement with a California municipality and a homeowners? association to resolve allegations of discrimination on the basis of familial status in violation of the Fair Housing Act. The settlement, in the form of a consent order, must be approved by the U.S. District Court for the Northern District of California.

The department?s lawsuit, which was filed on Nov. 21, 2011, alleged that the city of Santa Rosa, Calif., and La Esplanada Unit 1 Owners? Association, a homeowners? association, unlawfully sought to restrict residency at a housing development to seniors aged 55 and older. While the law allows an exemption for senior housing, the suit alleged that neither the city nor the homeowners? association took the steps, such as routine age-verification, necessary to qualify for an exemption to the Fair Housing Act .

Under the terms of the consent order, the city of Santa Rosa will not take any enforcement action against the housing development to force it to exclude families with children, and will waive the estimated $12,500 in costs associated with any zoning changes that may be necessary to bring the city?s regulation of the property into compliance with federal law. Further, when the city, through its zoning code, permits or requires a developer or property owner to operate senior housing, it will, among other things, designate the age restriction of the zoned property in its ordinances and zoning maps, and require that property owners for these developments submit biennial age verifications for the city?s review and certification. The city will designate an agency to review and certify the biennial certifications.

The homeowners? association also is prohibited from excluding families with children from the development unless it affirmatively elects to become an age-restricted community for persons 55 years of age or older and conforms to the requirements of the Fair Housing Act. The Fair Housing Act?s requirements include ensuring that at least 80 percent of the occupied units are occupied by at least one person who is 55 years of age or older and ensuring there are proper age verification procedures in place. In addition, the homeowners? association will provide compensatory damages to the aggrieved persons in an amount of $44,000 by providing a set-off to amounts it has claimed it is owed by the aggrieved persons.

The consent order also requires the homeowners? association?s officers, agents and employees, as well as city employees and agents with responsibilities related to zoning and land use to receive fair housing training, and requires the homeowners? association and the city to pay $5,000 each to the United States as a civil penalty.

?It is critical that families with children have opportunities to find housing,? said Thomas E. Perez, Assistant Attorney General for the Justice Department?s Civil Rights Division. ?We are pleased to achieve a resolution in this case that balances the housing rights of families against the ability of a municipality and community to maintain senior housing.?

?The resolution of this action is another step in the United States? continuing commitment to protect all of its citizens and to provide fair housing opportunities for people of all ages,? said Melinda Haag, U.S. Attorney for the Northern District of California. ?We are pleased to come to a just and speedy resolution with the city of Santa Rosa and the Homeowners? Association.?

This lawsuit arose as a result of a complaint filed with the Department of Housing and Urban Development (HUD) by the owner and representative of a portion of the condominium development that was the subject of the defendants? enforcement actions. After HUD investigated the complaint, it issued a charge of discrimination and the matter was referred to the Justice Department.

?This settlement gives Santa Rosa a path forward to have senior housing and protect the rights of families with children under the Fair Housing Act,? said John Trasvi?a, HUD Assistant Secretary for Fair Housing and Equal Opportunity.

The federal Fair Housing Act prohibits discrimination in housing on the basis of race, color, religion, sex, familial status, national origin and disability. LONDON (AP) ? Misty May-Treanor walked off the beach volleyball court at Horse Guards Parade holding a brightly colored cupcake ? a gift from partner Kerri Walsh Jennings' mother.

Their match, which started late and ran past midnight, ended too late for May-Treanor to blow out the pirate candle on her actual 35th birthday, but it was a victory worthy of a party.

"We're celebrating on California time," Walsh Jennings said early Tuesday morning in London after the 21-14, 21-19 victory over Czechs Marketa Slukova and Kristyna Kolocova.

It was the 16th consecutive Olympic victory for the two-time gold medalists. The Americans, who have never lost a set in three Olympics, fell behind 18-15 in the second before tying it 18-all.

The Czechs again took the lead but May-Treanor hit one off the heel of her palm into the far corner, then Slukova left two short of the net.

"We know that we can beat them," said Kolocova, who lost in the third set 15-13 to May-Treanor and Walsh Jennings in Rome earlier this summer. "But I think we are still not strong enough to change in our heads that it is possible."

Earlier Monday night, Americans Jake Gibb and Sean Rosenthal lost to Poland in pool play, the first loss for the American men or women in beach volleyball at the London Games.

Grzegorz Fijalek and Mariusz Prudel, the No. 7 team in the Olympic rankings, beat the Americans 21-17, 21-18. The U.S. team is 1-1 in pool play with one remaining match on Wednesday. They might not need to win, but a victory could be necessary to avoid relegation to a "lucky loser" playoff.

"It is a big game against Latvia," Rosenthal said. "We'll be ready."

The Americans had beaten the Polish pair in straight sets at the Berlin Grand Slam event in mid-July.

"They made some big adjustments from the last time we played them," Gibb said.

Fijalek said it was obvious they needed to make changes if they were going to compete with the Americans, who were No. 4 in the world coming into the games.

"Of course, because we lost very easy in Berlin," he said. "We watched that game many times. We played new beach volleyball."

Earlier in the night session, Sascha Heyer and Sebastian Chevallier of Switzerland beat Russia on a disputed call that ended with Russian Konstantin Semenov arguing with the referee and drawing a yellow card.

After winning a 31-minute first set ? as long as some entire matches ? 28-26, the Swiss lost the second 21-18. They trailed 13-11 in the 15-point third set before scoring three straight points.

On set point, Heyer's serve went untouched to the deep part of the court, and the linesman signaled it out. But the referee climbed down from her stand, walked over to examine the ball mark, climbed back to her stand, and signaled the winning point for the Swiss.

Semenov began arguing and didn't stop, even after the referee, Catriona Tweedie of Austria, held up the yellow card. Points can be awarded the other team for yellow cards, but at the end of the match it is meaningless.

"I'm not happy at all with the decision of the judge," said the other Russian, Serguei Prokopiev. "We play at such a high level, and this has happened before."

The Swiss also thought it was out until seeing the replay.

"I went back to get the next (serve), but suddenly my partner comes up to me and starts hugging me," Chevallier said. "Now we were lucky, and maybe two days from now we'll be unlucky."

Earlier Monday, defending bronze medalists Zhang Xi and Xue Chen recovered from an opening loss to beat Switzerland. The Chinese pair was upset in the very first match at Horse Guards Parade but would likely advance with a victory over Greece on Wednesday.

In other women's action Monday, medal favorites Juliana and Larissa of Brazil beat Katrin Holtwick and Ilka Semmler of Germany, and Czechs Hana Klapalova and Lenka Hajeckova beat Natacha Rigobert and Elodie Li Yuk Lo of Mauritius, both in two sets. Maria Tsiartsiani and Vasiliki Arvaniti of Greece beat Russia's Anastasia Vasina and Anna Vozakova 18-21, 21-13, 15-12.

In the men's competition, straight set victories went to Martin Spinnangr and Tarjei Viken Skarlund of Norway over Canadians Joshua Binstock and Martin Reader; Aleksandrs Samoilovs and Ruslans Sorokins of Latvia over Freedom Chiya and Grant Goldschmidt of South Africa; and Ricardo Santos and Pedro Cunha of Brazil over Britain's Steve Grotowski and John Garcia-Thompson. Germany's Julius Brink and Jonas Reckermann beat Wu Penggen and Xu Linyin of China 13-21, 21-19, 15-8.

Reporting is done based on the breast lexicon and every report is given a category of the BIRADS (Breast Imaging Reporting and Data System). This allows a uniform standard interpretation of the report.

According to the RCR guidelines, mammography is not recommended for generalised lumpiness, long standing nipple retraction and cyclical breast pain associated with periods.

The factors which protect from breast cancer are:

Four or more hours of exercise per week results in about 40 per cent reduction in breast cancer risk.
Physical exercise in adolescence was associated with significantly delayed breast cancer onset.
Healthy weight at menarche and at 21 years significantly delayed breast cancer onset.
Women who average 1.5 drinks per day have a 30 per cent increase in risk.

Climate change linked to ozone loss: May result in more skin cancer

ScienceDaily (July 26, 2012) ? For decades, scientists have known that the effects of global climate change could have a potentially devastating impact across the globe, but Harvard researchers say there is now evidence that it may also have a dramatic impact on public health.

As reported in a paper published in the July 27 issue of Science, a team of researchers led by James G. Anderson, the Philip S. Weld Professor of Atmospheric Chemistry, are warning that a newly-discovered connection between climate change and depletion of the ozone layer over the U.S. could allow more damaging ultraviolet (UV) radiation to reach the Earth's surface, leading to increased incidence of skin cancer.

In the system described by Anderson and his team, water vapor injected into the stratosphere by powerful thunderstorms converts stable forms of chlorine and bromine into free radicals capable of transforming ozone molecules into oxygen. Recent studies have suggested that the number and intensity of such storms are linked to climate changes, Anderson said, which could in turn lead to increased ozone loss and greater levels of harmful UV radiation reaching the Earth's surface, and potentially higher rates of skin cancer.

"If you were to ask me where this fits into the spectrum of things I worry about, right now it's at the top of the list," Anderson said. "What this research does is connect, for the first time, climate change with ozone depletion, and ozone loss is directly tied to increases in skin cancer incidence, because more ultraviolet radiation is penetrating the atmosphere."

Unfortunately, Anderson said, we don't know how this process will evolve over time.

"We don't know what the development of this has been -- we don't have measurements of this deep convective injection of water into the stratosphere that go back in time," Anderson said.

"But the best guide for the evolution of this is to look at the research that connects climate change with severe storm intensity and frequency, and it's clear that there is a developing scientific case that the addition of carbon dioxide to the atmosphere is increasing climate change, and in turn driving severe storm intensity and frequency."

While it's impossible to know how many skin cancer cases may be related to ozone depletion over the U.S., the link between ozone loss and increased incidence of the disease has been extensively studied, Anderson said.

"There has been a major effort by the medical community to define the relationship between decreases in ozone and the subsequent increases in skin cancer," he said. "The answer is quite clear -- if you multiply the fractional decrease in ozone protection by about three, you get the increase in skin cancer incidence. There are 1 million new skin cancer cases in the U.S. annually -- it's the most common form of cancer, and it's one that's increasing in spite of all the medical research devoted to it."

But it isn't only humans who have to worry about the effects of increased UV radiation.

Many crops, particularly staple crops grown for human consumption -- such as wheat, soybeans and corn -- could suffer damage to their DNA, Anderson said.

Ironically, Anderson said, the discovery that climate change might be driving ozone loss happened virtually by accident.

Though they had worked since the mid-1980s to investigate ozone depletion in the Arctic and Antarctic, by the early-2000s, Anderson's team had turned their attention to climate studies. In particular, they were working to understand how the convective clouds -- updrafts that cause storms to build high into the sky -- contribute to the creation of cirrus clouds.

"It was in the process of looking at that mechanism that we came to this unexpected observation -- that the convective clouds in these storm systems over the U.S. are reaching far deeper into the stratosphere that we ever expected," Anderson said.

While earlier tests performed in the Arctic had demonstrated that water vapor was a key component in creating the "free-radical" compounds that break down ozone, Anderson said the latest finding is much more troubling, because it suggests the process can happen at much higher temperatures than initially suspected.

"The bottom line is that if you increase the water vapor concentration, you actually increase the threshold temperature for executing this chemical conversion -- from the stable forms of chlorine to the free radical form," Anderson said. "If the amount of water vapor and the temperature over the U.S. satisfies the conditions for rapid conversion of inorganic chlorine to this free-radical form, we've got a real problem, because the chemistry is identical to what we previously demonstrated is taking place over the Arctic."

Also surprising, he added, was the realization that, to throw water vapor high into the atmosphere, storms needn't be unusually large.

"We have hundreds of measurements world-wide addressing the photochemical structure controlling ozone, but only a limited number of flights over the U.S. in summer," he said. "The flights were studying average storms over the middle-west, and of the 20 observations we made over the U.S., about half demonstrated significant penetration into the stratosphere," he said.

The next step in the research, Anderson said, is to conduct a series of tests to confirm whether the free-radical form of chlorine and bromine are present in the stratosphere at significantly elevated levels in the presence of convectively-injected water vapor.

"In my mind, this is not just a broad public health issue," Anderson said. "This is about actually being able to step out into the sunlight -- it's about your children and your children's health. Of course, we don't know how rapidly the frequency and intensity of these storms will increase, so we can't place a time scale on this problem, but the core issue here is quite straightforward and simple, because we understand this chemistry."

UK in a deeper recession than thought

LONDON (AP) ? Britain is suffering a far deeper recession than thought, official figures showed Wednesday in a development that is likely to increase the pressure on the government to ease up on its tough austerity approach.

The Office for National Statistics said the British economy contracted by a quarterly rate of 0.7 percent in the second quarter of the year. That was way more than the expectation in the markets for a far more modest 0.2 percent decline, and confirmed that the British recession has run into a third quarter.

The statistics office said the quarter was likely depressed by an extra day's holiday in June to celebrate the 60-year reign of Queen Elizabeth II. The wettest quarter since records began over 100 years ago is unlikely to have helped either.

Despite the caveats, the figures are likely to be big blow to the Conservative-led coalition government, which on entering office a little over two years ago put deficit-reduction at the heart of its economic program. Many, particularly the opposition Labour Party, think the medicine has been too much and choked the life out of the British economy, which is Europe's third-largest.

"We don't expect much policy response from government after today's news, though pressure will grow for a change of direction," said Scott Corfe, senior economist at the Centre for Economic and Business Research.

British Treasury chief George Osborne again blamed the economy's problems on debts run up by the previous Labour government and the impact of the Eurozone crisis.

"We all know the country has deep-rooted economic problems and these disappointing figures confirm that," Osborne said.

Last week, the International Monetary Fund said Prime Minister David Cameron's government may have to ease up on budget cutting if the economy fails to rebound strongly. The IMF cut its forecast for U.K. growth this year to 0.2 percent from 0.8 percent.

A more detailed look at the figures showed all sectors contributing to the quarterly decline. Output from the service industries including the financial sector was down 0.1 percent, manufacturing and other production industries were down 1.3 percent and construction fell 5.2 percent.

Britain has been in recession for much of the last four years. Like much of the world, it suffered a deep 18-month recession following the financial crisis. That only ended in the last quarter of 2009. Since the fourth quarter of 2009, GDP has fallen in five of the last seven quarters, and the latest result was the sharpest drop during that time. The technical definition of a recession is two successive quarters of decline.

The figures are at odds with other economic indicators. Unemployment has eased to 8.1 percent in the last report, with 250,000 private sector jobs added in the three months through April. Forward-looking surveys of business sentiment have been upbeat too.

"We can think of no reason why companies would be taking on staff at such an impressive rate if the economy really was collapsing to the extent that the GDP numbers suggest," said Chris Williamson, chief economist at financial data company Markit.

Other analysts suggest that employment enjoyed a short-term boost from hiring to support the Olympic Games.

Rosneft to talk to BP about buying TNK-BP stake

MOSCOW (Reuters) - State oil company Rosneft waded into the dispute between BP and its Russian partners on Tuesday, saying it is in talks to buy half of the troubled venture in a reminder the Kremlin is likely to fire the final shot in the battle.

British oil major BP has said it is seeking to exit its troubled but lucrative investment in Russia's third-largest oil company, TNK-BP . It formed the 50:50 joint venture with AAR, the consortium representing the tycoons, nearly a decade ago to tap into the country's vast energy reserves. The group is now estimated to be worth as much as $30 billion.

Rosneft's gambit signals the resolve of new Chief Executive Igor Sechin, the energy "tsar" in Russia's previous government, to build the country's largest oil company into a national champion of global scale.

"Rosneft has an established expertise and track record in managing large assets and considers the potential acquisition of BP's participation in TNK-BP to be an attractive commercial proposition," Sechin said in a statement.

"The potential acquisition would complement its existing portfolio and create value for all stakeholders."

AAR has already expressed its interest in buying half of BP's stake in TNK-BP, but would also consider selling for cash and BP stock to end a shareholder relationship that has broken down irretrievably.

BP said that while conducting discussions with Rosneft and any other interested parties, it will also negotiate in good faith with AAR.

Rosneft said it had agreed to enter negotiations with BP on buying its 50 percent stake in the joint venture and had signed a non-disclosure agreement.

AAR, led by banking-to-retail tycoon Mikhail Fridman, declined to comment. Last week AAR expressed its interest in buying 25 percent of BP's stake in TNK-BP, and has said it would be willing to pay $10 billion.

Under the TNK-BP shareholders' agreement BP cannot conclude a deal with anyone other than AAR for a period of 90 days.

MARRYING THE JUDGE

BP's stake in TNK-BP, acquired for $7 billion in 2003, is estimated by analysts to be worth between $25 billion and $30 billion.

"If this were to happen (Rosneft buys out BP), it would be the best-case outcome for BP, but the worst case for AAR and bad for (TNK-BP) minorities," Chris Weafer, chief strategist at Troika Dialog, said in comments emailed to Reuters.

BP, having agreed a deal with the state, would gain access to projects similar to those involving other Western energy majors, such as ExxonMobil , that have recently struck ambitious exploration agreements in Russia, Weafer added.

"It would still be in the Russia game, but with a cash payout and rid of its troublesome partners. A bit like getting a divorce and then marrying the judge."

Bankers and analysts said that, by selling, BP would realize a slug of cash that would help it to meet multibillion-dollar liabilities arising from the Gulf of Mexico disaster of 2010 but it would cut off much-needed cash flows from Russia.

BP has reaped $19 billion in dividends since buying into TNK-BP -- more than double its original investment. AAR has pointed out that TNK-BP contributed more than 90 percent to BP's dividends of $4.1 billion last year.

BP shares rose 0.4 percent by 8:43 a.m. EDT (1243 GMT), while Rosneft stock gained by 0.6 percent in Moscow. Shares in TNK-BP's listed unit, which has a small free float, fell by 0.6 percent.

Russian state-controlled banks would finance Rosneft's acquisition of BP's stake in TNK-BP, but would probably need the support of foreign lenders in a major syndicated deal, bankers said.

It is possible, analysts speculated, that Rosneft would buy all of TNK-BP in a deal that would create an 'oil Gazprom' with the sort of geopolitical clout that Russia's state-controlled gas export monopoly can project through its pipeline network.

Such a deal - involving a multi-billion-dollar payday for a group of unpopular business oligarchs - would present the Kremlin with a substantial public-relations challenge, however.

One banker close to AAR, meanwhile, said that its proposal to buy half of BP's stake was also bankable. Deal financing would be paid off within a few years out of TNK-BP's dividend flows, and the firm itself could be leveraged to finance a deal.

SELLING OUT

BP announced on June 1 that it would put its TNK-BP stake up for sale, giving AAR 45 days under the shareholder pact to express its interest.

Fridman quit as TNK-BP's chief executive in late May, days after Sechin was named Rosneft chairman in a move that signaled a major energy power shift in Russia after Vladimir Putin's re-election for a third presidential term.

Sechin had been thwarted a year earlier by AAR in his attempt to forge a strategic offshore exploration deal and share swap between Rosneft and BP. AAR, which had blocked the alliance in the courts, turned down a $32 billion last-ditch joint bid by Rosneft and BP to buy it out in May 2011.

The prospect of partnering now with a state company may not be palatable for Fridman and his co-investors -- German Khan, Viktor Vekselberg and Len Blavatnik. One scenario would be that it is they who end up exiting the business, some analysts say.

"My opinion is that the end deal is going to be AAR exiting rather than BP, because I really don't see a way for Sechin to work with AAR," said one analyst from a Western bank in Moscow, speaking on condition of anonymity.

"I think the end deal is BP and Rosneft together buying out the AAR stake, 25 percent each. That could easily be financed by Rosneft and BP."
